Recovery of Bill Review Reductions

Recovery After Award

All awards are calendared to ensure prompt payment. Follow-up action is taken, as needed, including obtaining penalties and interest when appropriate and Petition for Certified Enforcement of Award.

Penalties and Interest

GIRGIS & ASSOCIATES, INC., will file the appropriate petition with the Workers' Compensation Appeals Board for 10% penalty & 7-10% interest on your lien according to the Division of Industrial Accident Rules & Regulations.

Compromise & Release

When case(s) are settled by direct payment from the employer's carrier to the injured worker or his/her representative attorney, quite often the only means of payment to the lien claimant is from the carrier directly. All too often a second round of fee negotiations results. Especially if the lien is disposed of by (C&R) the Judge may reduce a lien. If this procedure is appropriate, one must know how to compute the potential case value using the current applicable law. UNLESS CASE VALUES ARE CHALLENGED PROPERLY, LIENS MAY BE IMPROPERLY REDUCED OR ELIMINATED.
